Sky365TM ROOF PANEL LIMITED PRODUCT WARRANTY
1. Limited Warranty. Lux-Products (“Company”) warrants, subject to the exclusions and limitations set out below in this Limited Product Warranty (“Limited Warranty”), the Sky365TM Roof Panel (the “Product”) for the period of one (1) year from the date of purchase, to be free of defects in workmanship or materials. the date of purchase.
2. Warranty Coverage. If the Company finds the product to be defective in workmanship or materials, with the defect existing as of the time of purchase, the Company, in its sole discretion, may replace the Product with the Sky365TM Roof product or one of equal or lesser value. This is the Customer’s sole and exclusive remedy. The Customer shall be responsible for all labor, removal, shipping, and installation costs.
3. Exclusions from Limited Warranty. This Limited Warranty does not cover defects or damage caused by:
a. Improper installation of the product.
b. Normal wear and tear or loss of performance over time
c. Misuse, abuse, or neglect of the Product
d. Unauthorized repairs or modifications.
e. Lack of maintenance.
f. Accidents or external causes, including accidents involving use of the vehicle,
fire, flood, wind, or natural disasters.
4. Conduct that will Void the Limited Warranty. This Limited Warranty will be voided for:
(1) any deviation from instructions or installation, use, or care of the Product; (2) any Customer or third party modifications to the Product; (3) purchasing the Product from any place not approved by Company as a retailer or supplier of the Product, or (4) reselling the product to a successive user.
5. Warranty is Not Transferable. This Limited Warranty extends only to the original
purchaser (“Customer”) and is not transferrable.
6. Submitting a Limited Warranty Claim. For Limited Warranty claims, please contact Lux-Products here https://sky365roof.com/pages/contact, and be prepared to submit the following information, all of which are required to evaluate the claim: (1) proof of product purchase, (2) photos or video of the product(s) with a brief description of the indicated issue, and suspected cause (include year, make & model of vehicle with any other aftermarket products installed), (3) Customer contact information and shipping address.
7. Company Will Decide Warranty Claim. If Customer submits a claim under this Limited Warranty, Company reserves the right to review Customer’s claim and verify the cause or condition leading to the claim. If, after Company’s independent review of the claim, Company determines Customer’s claim is not property supported by adequate documentation, or upon inspection of the Product, the Company determines that the damage was not a result of defects in workmanship or materials, then Company may deny such claim. The Company will solely
determine final disposition of any warranty claim.
8. Legal Claims. Customer and Lux-Products agree that each may bring claims against the other in arbitration or litigation only in the Customer’s or Lux-Products’ individual capacity and not as a class member in any purported class, collective, consolidated, private attorney general, or representative action. Any legal claim related to the purchase of the Product or this Limited Warranty must be filed as a single customer claim in a court of competent jurisdiction within Oakland County, State of Michigan, no later than the expiration of the one (1) year Limited Warranty period, which starts on the date of purchase of the Product. This provisions
specifically modifies and limits the right of the Customer to make a warranty claim outside the warranty period.
9. Exclusions of Other Warranties and Damages. LUX-PRODUCTS DISCLAIMS ANY EXPRESS WARRANTY NOT PROVIDED HEREIN AND ANY IMPLIED WARRANTY, GUARANTEE OR REPRESENTATIONS AS TO THE SUITABILITY FOR ANY PARTICULAR PURPOSE, PERFORMANCE, QUALITY AND ABSENCE OF HIDDEN DEFECTS, AND ANY REMEDY FOR BREACH OF CONTRACT, WHICH BUT FOR THIS PROVISION, MIGHT ARISE BY IMPLICATION, OPERATION OF LAW, CUSTOM OF TRADE OR COURSE OF DEALING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. EXCEPT AS PROVIDED IN TRHIS AGREEMENT, LUX-
PRODUCTS FURTHER DISCLAIMS ANY RESPONSIBILITY FOR LOSSES, EXPENSES, INCONVENIENCES, SPECIAL, INDIRECT, SECONDARY OR CONSEQUENTIAL DAMAGES ARISING FROM OWNERSHIP OR USE OF THE PRODUCTS.
10. Rights under Warranty. This Limited Warranty gives you specific rights. You may also have other rights that vary from state to state. For example, some states do not allow limitations of how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the limitations and exclusions herein may not apply to you. All other warranties are hereby disclaimed, except to the extent prohibited by applicable law.
11. Changes to Limited Warranty. The Company may change, amend, alter, or supplement provisions of this Limited Warranty at any time, effective when such changes are posted on the Company website. No employee, reseller, or other agent of Lux-Products is authorized to amend this Limited Warranty or make additional representations or warranties regarding any Lux-Products product.
